Entitlements Statements
The majority of farmers in England have been sent their 2009 Entitlements Statement. It is important that you check that your entitlements are correct and write to us as soon as possible to let us know if you think they are not.
However, farmers and growers of permanent fruit and vegetables, nursery crops or vines who successfully applied for new entitlements please note that you might not receive your Entitlements Statement until early 2010. This includes farmers who already hold entitlements and have applied for additional new entitlements.
Please note, your SPS payment amount will be less than the value of your entitlements shown on your Entitlements Statement. This is because your Entitlements Statement does not take account of deductions, such as modulation.

Corrections of entitlements
All cases where farmers write to RPA disagreeing with their allocation and supplying details as to why they think the allocation is too low will be investigated. However, you should note that Article 137 of Council Regulation 73/2009 limits the types of corrections to your entitlements we can make after 31 December 2009.
Circumstances where we will continue to make entitlement corrections (either number or value) from 1 January 2010 include:
- Where we find the allocation of entitlements (either number or value) was too low. In those cases we will continue to correct to make increases in line with existing legislation.
- Decreases to the allocation of entitlements (either number or value) where the over allocation was based on factually incorrect information on the application which the farmer should have known about.
- Corrections which do not affect the allocation of entitlements, e.g. changes to entitlement transfers, usages and expiry dates.
Article 137 doesn’t apply to any entitlements allocated after 1 January 2009 (e.g. new entitlements for permanent fruit and vegetables, nursery
crops and vines).
